MiMojo is the easy way to send and receive mobile video files for professional uses.

 

Please read these Terms of Service ("Agreement") carefully before using the MiMojo services, software, websites (including browser extensions), and/or applications (together: “Service” or “Services”) provided by MiMojo Co. ("MiMojo," "we," or "us") which are bound by this Agreement.

 

1. Acceptance of Terms

 

1.1 By using the MiMojo Service, you agree to comply with this Agreement and any additional terms and conditions that may apply to specific features or services provided by MiMojo.

 

2. Use of Service

 

2.1 MiMojo offers the following services:

• A web and mobile app (“MiMojo”) to share media files with metadata and captioning 

• An assignment manager in the MiMojo app for certain subscribers

• Features that enable users to leverage cloud media and AI services

MiMojo provides a file transfer service that allows users to securely share files and associated metadata (together: “Content”) up to a maximum total capacity outlined www.mimojo.co/subscription-options. MiMojo currently has free and monthly and annual subscription plans. For both you need to register as a user which involves providing us with your username, email, and cell phone number. After the expiry period outlined in the subscription, MiMojo will permanently delete the uploaded files.

 

2.2 The Service may be provided to you online, in the form of a mobile and/or desktop application(s), and/or may be integrated into a third party service.

 

2.3 You are only allowed to use the Service when age 16 or older.

 

3. User Responsibilities

 

3.1 You are solely responsible for the content you upload, share, and store using the MiMojo Service. You must ensure that your use of the Service does not violate any applicable laws or infringe upon the rights of others.

 

3.2 You agree not to use the Service for any illegal or unauthorized purpose, including but not limited to the unauthorized sharing of copyrighted materials.

 

3.3 MiMojo does not control the use of download links, regardless of if they are originally distributed by us or by you. Recipients can forward the links and allow others to use them. You are responsible for the Content you share and for any such use.

4. Fees and Payments

 

4.1 MiMojo offers both free and paid subscription plans. The pricing and payment conditions for each plan are outlined in the pricing section of the MiMojo website www.mimojo.co/subscription-options.

 

4.2 If you subscribe to a paid plan, you agree to pay the applicable fees according to the selected billing cycle. Payment processing may be handled by third-party payment processors, and additional terms and conditions may apply.

 

4.3 All fees are non-refundable, and MiMojo does not provide refunds or credits for any partial subscription periods or unused features.

 

5. Term and Termination

 

5.1 This Agreement shall remain in effect until terminated by either party.

 

5.2 You may cancel your subscription at any time by following the instructions provided in the MiMojo account settings or by contacting our customer support.

 

5.3 MiMojo may, at its discretion, suspend or terminate your access to the Service if you violate this Agreement or engage in any activity that may harm the Service or its users.

 

6. Intellectual Property Rights

 

6.1 MiMojo retains all rights, title, and interest in and to the Service, including any intellectual property rights and trademarks associated with it. You may not use the MiMojo name, logo, or trademarks without our prior written consent.

 

7. Violation of the Terms of Service

7.1 MiMojo reserves the right to investigate, provide to third parties, (temporarily) block and/or remove, without warning, any Content and/or accounts or to block anyone from accessing any part of the MiMojo websites or Services, when MiMojo ascertains, at their own discretion or after receiving substantiated and valid complaints, that you violate these Terms of Service or act in violation of any applicable law or regulation. 

 

7. Limitation of Liability

 

7.1 To the extent permitted by applicable law, MiMojo shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Service. MiMojo makes no warranty that the Services are available on an uninterrupted, secure or error-free basis. Your use of the Services is at your own risk. You acknowledge and agree that MiMojo is not responsible for any damages to your computer system or the computer system of any third party that results from the use of the Services and is not responsible for any failure of the Services to store, transfer or delete a file or for the corruption or loss of any data, information or content contained in a file.

 

8. Governing Law

 

8.1  This Agreement will be governed by and construed in accordance with the substantive laws of the State of Delaware without regard to conflict of laws and all disputes arising under or relating to this Agreement shall be brought and resolved solely and exclusively in the State Court located in Delaware. 

 

9. Modifications to the Agreement

 

9.1 MiMojo reserves the right to modify or update this Agreement at any time. Any changes to the Agreement will be effective upon posting the updated Agreement on the MiMojo website. It is your responsibility to review the Agreement periodically for any modifications. Your continued use of the Service after the posting of any changes constitutes your acceptance of the modified Agreement.
